Suspect seeks determination of immunity in first-degree murder case

A Weatherford man charged with first-degree murder — deliberate intent has requested a motion for determination of immunity and a request for an evidentiary hearing.

Cole Issac Phillips, 22, allegedly shot his friend Josh Price during an altercation April 4, according to court records.

Phillips appears by his attorney Ryan D. Recker. During a preliminary hearing November 5, Recker requested the charge of first-degree murder — deliberate intent to be dropped and the incident be ruled as self-defense. Associate District Court Judge Donna Dirickson over ruled the request and the original charge remained.

Phillips requested an evidentiary hearing to further his claim he is entitled to immunity in this case due to his claim of self defense, according to court records. During an arraignment November 30 Cole Issac Phillips pleaded not guilty to first-degree murder — deliberate intent. Phillips is currently awaiting a jury trial date.

As of press time Monday an evidentiary hearing has not been scheduled. The next event for the case is a pretrial docket scheduled for February 26.
