The victim had allegedly not eaten the day police were called and also had a large cut on his foot which was covered with dirt and animal feces, according to the probable cause affidavit filed October 7 by Custer County District Court.

Shepherd Home Health reported the incident to police. The nurse charged was not employed by Shepherd.

Christina Marsh, a nurse the victim had hired, was allegedly allowed to stay in the victim’s home rent free as long as she would care for him and help with mitigating his health issues. Marsh also was allowed to have her family live in the home with her. The family included her husband, daughter and grandsons, according to court records.

The victim was unable to cook or bathe himself and was unable to be mobile without a walker and lacked dexterity or mental capacity to maintain his own prescribed medication, schedule or nutrition, according to the affidavit.

Marsh allegedly had left the victim’s house covered in dirt and large piles of trash with a strong smell of animal urine and feces. Flies also swarmed the house, along with cockroaches and bedbugs, according to court records.

The victim’s health was in a declining state through the time Marsh had been taking care of him.

A home health nurse was called to come to the victim’s house and clean him, fed him and also contacted police, according to the affidavit.
