Clinton man charged with sexual battery

Wesley Edmund Davis-Pratt, 22 of Clinton, was arrested May 29 and charged with sexual battery, second-degree burglary and public intoxication, according to the affidavit of probable cause filed with the Custer County District Court.

Clinton Police Officer Adam Mitchell was dispatched to a residence in Clinton May 29 in reference to a male subject, later identified as Davis-Pratt, who allegedly broke into the residence and attempted to remove the pants of a female victim. The report came from the victim’s grandfather, court records show.

Upon arrival, the grandfather told Officer Mitchell he knew the perpetrator to be Davis-Pratt. He said Davis-Pratt was wearing a black jacket and blue jeans and had just left the house, heading west. Officer Mitchell canvassed the area and found a man, Davis-Pratt, matching the description, according to court records.

Upon contact with Davis-Pratt, Officer Mitchell observed his speech to be thick and slurred, his eyes to be red and watery and his balance to be off. Officer Mitchell smelled an odor of an intoxicating beverage coming from Davis-Pratt as well, court records show.

Officer Mitchell arrested Davis-Pratt for public intoxication and took him back to the scene of the crime to see if the victim or her grandfather could positively identify Davis-Pratt as the perpetrator. The grandfather told Officer Mitchell, “That’s him,” according to court records.

The grandfather said he was in his back yard at about 2:56 p.m. when his great granddaughter came running outside saying a man, allegedly Davis-Pratt, was trying to do something to her mom, the victim. The grandfather then went back into the house and allegedly saw Davis-Pratt standing by the front door. The grandfather said he told Davis-Pratt he needed to leave and he was going to call the police, court records show.

The victim told Officer Mitchell she had been asleep in the living room on the couch and was woken up by a man she knew as Davis-Pratt. The victim said Davis-Pratt allegedly was trying to get under the blanket with her so she went into her in-laws bedroom to get away from him, according to court records.

The victim said Davis-Pratt allegedly followed her into the bedroom and attempted to pull down her pants. The victim said Davis-Pratt was unsuccessful in pulling her pants down completely. The victim broke away from Davis-Pratt and ran out of the house and into the front yard. The victim said Davis-Pratt allegedly gained entrance into the home through either the front or back door. She said she was unsure because both were unlocked at the time, court records show.

Davis-Pratt is scheduled to appear in court June 24, according to court records.
