A Clinton man has been charged with two felony counts and three misdemeanors after events which transpired last Saturday.
According to the information sheet filed with Custer County District Court, Draven Lenny Lollar, 25 of Clinton, is being charged with felony kidnapping, possession of a firearm during the commission of a felony, pointing a weapon at another person, disrupting an emergency phone call, and discharging a firearm in a public place.
September 5, Lollar allegedly forcibly seized and confined his victim in their home west of Clinton “without lawful authority” and against the victim’s will. If convicted of this felony charge, Lollar faces up to 20 years in prison, according to the information sheet.
During the forcible seizure and confinement, Lollar allegedly was in possession in of a black, semiautomatic .22-caliber rifle, which was “capable of raising in the mind of one threatened with such a device a fear it was a real firearm.” This is a felony offense punishable with imprisonment from 2 years up to 10 years, according to the information sheet.
Lollar also allegedly pointed the rifle at the victim for reasons other than self-defense. This is punishable by a fine of $100 up to $1,000, imprisonment from 3-12 months or both, according to the information sheet.
Lollar allegedly prevented the victim from contacting emergency services by taking the phone away from them. Disruption, prevention or interrupting an emergency phone call is a misdemeanor. If convicted, Lollar is facing a fine of $3,000, 1 year in county jail or both, according to the information sheet.
Lollar also is facing a charge of discharging a firearm in a public place for allegedly discharging his rifle at the skirting of the victim’s trailer home, “which is a place where people were endangered of the firearm.” This offense is a misdemeanor and punishable by a fine up to $500, imprisonment up to 1 year or both, according to the information sheet.
If convicted on all counts, Lollar faces up to 33 years of imprisonment and fines up to $4,500.
